Terms of Service
The short version. This is a summary, not a replacement for the full terms below.
- OnCallAlert is self-hosted. You run it on your own servers, and you are responsible for keeping it running, secure, and backed up.
- Alerts are sent by your own instance, so they are as reliable as the servers and providers you run it with. Mobile push goes through our relay on Cloudflare's global network; if the relay is ever unavailable, only push is affected, and SMS, voice calls, and email keep working.
- The software is provided "as is". If something goes wrong, our total liability is limited to what you paid us in the previous 12 months.
- Payments are handled by Dodo Payments as Merchant of Record. Refunds are available within 30 days of a payment for a valid reason.
- These terms are governed by the laws of India, with courts in Bengaluru, Karnataka.
1. Agreement
These Terms of Service ("Terms") are an agreement between you and OnCallAlert ("OnCallAlert", "we", "us", "our"), operator of oncallalert.dev. They apply when you visit our website, buy a subscription, download or run the OnCallAlert software, use the OnCallAlert mobile app, or use our push relay and license services.
By buying a subscription, entering a license key, or using any of these services, you agree to these Terms. If you accept on behalf of a company or other organization, you confirm that you have authority to bind it, and "you" means that organization.
OnCallAlert is a business tool sold to organizations and professionals. It is not intended for personal, household, or consumer use. You must be at least 18 years old to accept these Terms.
2. Definitions
- Software: the OnCallAlert server program and web interface that you install and run on infrastructure you control, including updates we provide.
- Mobile App: the OnCallAlert companion app for Android and iOS.
- Hosted Services: the services we operate ourselves: the push relay that wakes the Mobile App, the license server, and this website.
- Subscription: a paid plan, monthly or yearly, as described on our pricing page at the time of purchase.
- License Key: the key we issue for your Subscription, which unlocks the features of your plan.
- Your Instance: your installation of the Software, together with its database, configuration, and the servers and network it runs on.
- Your Data: all data stored in or processed by Your Instance, such as alerts, schedules, users, contact details, and integration settings.
3. Your License
While your Subscription is active and paid, we grant you a non-exclusive, non-transferable, non-sublicensable license to install and run the Software on infrastructure you control, and to use the Mobile App and Hosted Services with it, for your organization's internal business purposes and within the limits of your plan (for example, the number of users and the features included).
OnCallAlert is built on open-source software, including GoAlert, which is licensed under the Apache License 2.0. Open-source components remain under their own licenses, and nothing in these Terms limits the rights those licenses give you. These Terms govern the OnCallAlert-specific components, the License Key, the Mobile App, the Hosted Services, and your Subscription. Some OnCallAlert components are published under the Business Source License 1.1; where they are, that license also applies.
We and our licensors keep all rights not expressly granted to you.
4. License Keys and Enforcement
The Software checks your License Key with our license server, normally about once a day. This check is the only way we limit use of the Software. It sends a small set of technical details, described in our Privacy Policy, and never sends your alerts or other Your Data.
- If your Subscription ends, is not renewed, or the License Key is revoked, the Software continues to work for a grace period of 30 days, after which paid features are locked until a valid License Key is entered.
- If Your Instance cannot reach our license server (for example, because of a network problem), it continues to work on its last valid license for at least 30 days, so short outages of our license server do not interrupt your alerting.
- Keep your License Key confidential. You are responsible for all use of it. Tell us promptly if you believe it has been exposed, and we will issue a replacement.
- You must not share your License Key with another organization, or bypass, disable, or tamper with license checks or plan limits.
5. Your Responsibilities as a Self-Hosted Customer
Your Instance runs on your infrastructure, under your control. We do not operate, monitor, back up, or have access to it. You are solely responsible for:
- the servers, database, operating system, network, domain, TLS certificates, and any cloud or hosting accounts Your Instance uses, and keeping them available;
- installing, configuring, securing, updating, and backing up Your Instance and Your Data;
- configuring services, escalation policies, schedules, integrations, and contact methods correctly, and keeping them up to date;
- regularly testing that alerts reach the right people through every channel you rely on;
- setting up more than one notification method for important alerts (for example, a mobile push followed by a Twilio voice call);
- making sure each user's phone has notifications, critical alerts, and any "do not disturb" overrides enabled, and that the Mobile App is not restricted by battery or data-saving settings;
- any third-party providers you connect to Your Instance (for example SMS, voice, or email providers), including their fees and terms;
- having a lawful basis and any consent required to store people's contact details in Your Instance and to send them SMS, voice calls, emails, or push notifications; and
- complying with the laws that apply to Your Data and your use of the Software.
For Your Data, you are the data controller (or "data fiduciary") under data-protection laws. Because we cannot access Your Instance, we cannot recover, export, correct, or delete Your Data for you.
6. How Alert Delivery Works
OnCallAlert is self-hosted, so Your Instance is what creates and sends alerts. As long as Your Instance and the notification providers you connect are running, alerts go out on every channel you have configured.
- SMS, voice calls, email, and webhooks are sent directly from Your Instance through the providers you connect (for example, Twilio for SMS and voice). They do not pass through our servers.
- Mobile push is sent through our push relay, which runs on Cloudflare's global network, and then through Google Firebase Cloud Messaging and Apple Push Notification service to the phone. If the relay is ever unavailable, only mobile push is affected; every other channel keeps working.
Recommended setup
For important services, add a Twilio voice call (or SMS) as a later step in your escalation policy. If a push notification is not acknowledged in time, OnCallAlert calls the on-call person's phone. Send a test alert from time to time to confirm every channel reaches your team.
What we can and cannot promise
Delivery also depends on systems that neither we nor you fully control, such as cloud and network providers, mobile carriers, Google and Apple push services, and each person's phone settings and signal. For that reason we cannot guarantee that every notification arrives, or arrives at a specific time, and we are not liable for losses caused by a delayed or missed notification, as set out in Sections 12 and 13.
OnCallAlert is built for engineering and operations teams responding to technical incidents. It is not designed or certified for emergency dispatch, medical, or other life-safety uses.
7. Push Relay and Other Hosted Services
On plans that include the Mobile App, Your Instance sends wake-up triggers through our push relay. A trigger contains only identifiers (a device ID and an alert ID), never the alert's text. The Mobile App then fetches the alert details directly from Your Instance.
- The Hosted Services are provided on an "as available" basis with no uptime commitment or service-level agreement unless we have agreed one with you in writing.
- We may apply rate limits, perform maintenance, and change or discontinue features. If we discontinue the push relay while you have a paid Subscription that includes it, we will give reasonable notice where we can and, if no reasonable alternative is offered, refund the unused, prepaid part of that Subscription.
- We may suspend access to the Hosted Services to protect them, other customers, or third parties, for example in response to abuse, a security threat, or non-payment.
8. Subscriptions, Billing, and Taxes
Our checkout and payments are handled by Dodo Payments, which acts as our Merchant of Record and reseller. When you buy a Subscription, Dodo Payments processes the payment, calculates and collects applicable sales tax, VAT, or GST, and issues your invoice. Their own terms and privacy policy also apply to the purchase.
- Prices are shown on our pricing page and at checkout. Taxes may be added depending on your location.
- Subscriptions renew automatically at the end of each monthly or yearly period, using the payment method on file, until cancelled.
- You can cancel at any time. Cancellation stops the next renewal; your plan stays active until the end of the period you have already paid for.
- We may change prices for future periods. We will tell you at least 30 days before a price change applies to your Subscription, and you can cancel before it takes effect.
- If a payment fails, we or Dodo Payments may retry it. If it is still unpaid, your License Key may be suspended under the grace rules in Section 4.
9. Refund Policy
You may request a refund within 30 days of a payment if you have a valid reason. Valid reasons include:
- the Software does not work as described in our documentation on a supported setup, and we could not fix the problem within a reasonable time after you reported it;
- you were charged twice, or charged the wrong amount;
- you were charged for a renewal after you had cancelled; or
- the License Key was not delivered and we could not resolve it.
To request a refund, email contact@oncallalert.dev from the address used at checkout, with your order or invoice number and the reason. We review each request in good faith and reply within 7 business days. Approved refunds are issued through Dodo Payments to the original payment method; the time it takes to appear depends on your bank. When a refund is issued, the License Key for that period is revoked.
Refunds are generally not given for a change of mind after the License Key has been used, for problems caused by your own infrastructure or configuration, for partial billing periods after the 30-day window, or for issues covered by Section 6. This does not affect any refund rights you have under the law of your country that cannot be waived.
Please contact us before opening a dispute or chargeback with your bank. Most billing problems can be solved faster by email.
10. Restrictions
Except where an open-source license expressly allows it, you must not:
- resell, sublicense, or rent the Software, the Mobile App, or a License Key;
- use the Software, the Mobile App, or the Hosted Services to provide a hosted, managed, or paid on-call or alerting service to third parties;
- circumvent license checks, plan limits, or rate limits, or reverse engineer the license mechanism;
- remove or alter copyright, license, or attribution notices;
- use the Hosted Services to send spam, malware, or unlawful content, or to interfere with or overload them; or
- use any part of OnCallAlert in breach of applicable law, including export-control and sanctions laws.
11. Support and Updates
Support is provided by email at contact@oncallalert.dev on a reasonable-effort basis, unless your plan or a separate written agreement states specific response times. We may publish updates to the Software and Mobile App, but are not required to provide any particular update or feature. You decide when to update Your Instance and are responsible for testing updates before relying on them.
If you send us ideas or feedback, we may use them without any obligation to you.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Software, the Mobile App, the Hosted Services, the website, and all documentation are provided "as is" and "as available", with all faults and without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade. We do not warrant that any of them will be uninterrupted, timely, secure, error-free, or free of harmful components, that any alert or notification will be generated or delivered, or that defects will be corrected.
Free trials, beta features, and the Software used without a paid Subscription are provided without any commitment, and to the extent permitted by law we have no liability for them.
13. Limitation of Liability
To the maximum extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, or anticipated savings, loss or corruption of data, cost of substitute services, downtime, missed, late, or failed alerts or notifications, failure to detect or respond to an incident, or service-level credits or penalties owed to your own customers, however caused and under any theory of liability, even if we were told such damages were possible.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to these Terms, the Software, the Mobile App, or the Hosted Services is limited to the amount you actually paid for your Subscription in the 12 months before the event giving rise to the claim. If you have paid nothing, our total liability is zero.
These limits apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence. The fees for OnCallAlert reflect this allocation of risk.
14. Indemnity
You will defend and indemnify us against claims, damages, fines, and reasonable costs (including legal fees) brought by third parties arising from Your Data, your operation of Your Instance, your messages to people through the Software, or your breach of these Terms or of applicable law.
15. Suspension and Termination
You can stop using OnCallAlert and cancel your Subscription at any time. We may suspend or terminate your License Key and access to the Hosted Services if you materially breach these Terms (including Section 10) and do not fix the breach within 14 days of notice, or immediately where needed to prevent harm, fraud, or legal liability.
When your license ends, your right to use paid features ends after the grace period in Section 4. Your Data stays on your infrastructure and remains yours. Sections 6 and 9 through 17 survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting any formal proceedings, you agree to contact us at contact@oncallalert.dev and try in good faith to resolve the dispute informally for at least 30 days. If it is not resolved, the courts at Bengaluru, Karnataka, India will have exclusive jurisdiction, and both parties submit to those courts.
17. General
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of internet, cloud, push-notification, or telecom providers, power failures, natural disasters, war, government action, or cyber-attacks.
- Changes. We may update these Terms. For material changes we will post the new version here and, where we have your email, notify you at least 15 days before they take effect. Continuing to use OnCallAlert after that means you accept the new Terms. Changes do not apply to disputes that arose before them.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of the business.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement on this subject, unless we sign a separate written agreement with you, which then takes priority where they conflict.
- Severability and waiver. If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it.
- Independent parties. Nothing in these Terms creates a partnership, agency, or employment relationship.
- Notices. We send notices to the email address associated with your Subscription. You send notices to contact@oncallalert.dev.
